Terms and Conditions

These Terms and Conditions govern the services provided by PhotographyByMo, hereinafter referred to as "the Photographer," to the client ("the Client"). By booking a session or purchasing services from PhotographyByMo, the Client agrees to the following:

1. Booking & Payment

• A non-refundable retainer fee of 30% is required to secure your session date and time. The remaining balance is due no later than the day of the session.

• Booking is not confirmed until the retainer fee has been received.

• Accepted payment methods include: cash, bank transfer, and online payment platforms (e.g., Zelle, Venmo, etc.).

2. Cancellation & Rescheduling

• Cancellations made by the Client less than 72 hours before the session will forfeit the retainer fee.

• Rescheduling is allowed once with at least 72 hours' notice and must be completed within 60 days of the original date.

• The Photographer reserves the right to reschedule in case of weather conditions (for outdoor shoots), illness, or emergency.

3. Session Conduct

• The Client is responsible for arriving on time and being prepared for the session. Late arrival will result in reduced session time.

• The Photographer is not responsible for uncooperative subjects or missed moments due to client lateness or unpreparedness.

4. Creative Control

• The Photographer maintains full creative control over the style, composition, and editing of images.

• Edits include standard color correction, lighting, and minor blemish removal. Additional retouching (e.g., body reshaping, heavy manipulation) may incur an extra fee.

5. Image Delivery

• Edited images will be delivered within 2 to 4 weeks via an online gallery.

• The Client will receive a set number of high-resolution images as per the chosen package.

• RAW or unedited images are not provided.

6. Copyright & Usage

• The Photographer retains full copyright of all images.

• The Client receives a personal-use license to print and share images non-commercially.

• For commercial or business use (branding, advertisements), a separate licensing agreement must be signed.

• The Client may not sell, alter, or publish the images for profit without written permission.

7. Model Release

• By booking a session, the Client grants the Photographer permission to use images for promotional purposes, including but not limited to the Photographer’s website, portfolio, marketing materials, and social media.

• If the Client does not wish to have their images used, a written request must be submitted prior to the session.

8. Liability

• The Photographer is not liable for any injuries, property damage, or loss incurred during the session.

• In the unlikely event of equipment failure, data loss, or other unforeseen circumstances, liability is limited to the return of the retainer and any other fees paid.

9. Force Majeure

• The Photographer shall not be held liable for failure to perform any part of this agreement due to fire, strike, or other causes beyond control, including illness, extreme weather, or acts of God.

10. Agreement

• By submitting a booking and/or payment, the Client confirms they have read, understood, and agreed to the above Terms and Conditions.

• These Terms may be updated at any time. Clients will be notified of major changes prior to their session date.
